@internetarchive @team The publisher's argument accusing that the IA didn't pay publishers or authors is flat out wrong. Simply not paying? So if I donate a purchased book to a library, is that library responsible to pay to authors? Did they not know that people can buy products on their behalf? You might as well demand children to pay them just because their parents gave it to them.
@internetarchive @team If you go to a bookstore, take a book off the shelf, read a few pages for a few seconds, and then put it back, is that stealing?
@AndersBaerbock @socks @internetarchive Plus, libraries don't necessarily buy a replacement copy if the book have minor damage, such as a small torn on the page. Would you ban libraries taping the pages back together?
@socks @AndersBaerbock @internetarchive Agreed. It only matters if there's an actual contract or not, not digital or not. Most physical books don't have software-styled licensing agreements - the books the IA have in their OL or books they have permission voluntarily given by authors allowing CDL.
@AndersBaerbock @internetarchive Don't you guys have phones with cameras? Any questionable patron can snap pictures of the text of the content be it on the page made from trees, or on plastic or glass screen of another device.

The digitized books can only be downloaded a limited number of times, akin to how many books from a real bookshelf can be taken before they do not have it.

Books can be pirated easily by patrons? It uses DRM (prevents piracy, and enforces the time limit before auto-return), and accusing the DRM is "too weak" means you should also demand physical libraries to hire policemen to monitor every patron's behavior of potentially snapping pictures of the book.

It is reproduced & transmitted, but not an infringement when the reproduced content is not really freely accessible. These text aren't legally binding, just because they don't mention fair use doesn't mean fair use doesn't apply. They can say whatever the f*ck they want. I've seen several users not wanting their content to be criticized, or even their legally posted stuff to be linked, it doesn't mean copyright enforces this.
