Such a dumb redundancy, if they work on classified info, they already have the equivalent of this in place. #Trump is just too ignorant to know, so he wants to use what he knows from business & his multiple sexual assaults.

The draft notice, which will be published Wednesday & be open for a 30-day public comment period, uses an *expansive* definition of *privileged information*, beyond typical classified & unclassified designations. The draft blocks employees from sharing “non-public, confidential, or proprietary information” or “any sensitive, pre-decisional or deliberative material that is not currently publicly available & should not be disclosed under applicable law.”

@Nonilex I don’t understand how this draft notice changes anything that already exists.

When I worked for the government there was an unclassified category called “For Official Use Only” which was barred from disclosure outside the government. This could be modified by adding the words “—Pre-Decisional” if a document was specifically related to procurement or policy. It was recommended that documents be marked, like classified material, but not required.

@meltedcheese Your right. That FOUO category is currently called Controlled Unclassified Information at most agencies. If info is so designated, federal people and contractors are prohibited from disclosing. Making people sign presumably will help them enforce the NDA. In addition to the CUI designation, some agencies currently also require NDAs. @Nonilex

@meltedcheese Classified is different and more so as you know the higher level classifications. There are additional storage and system requirements. I haven’t read the NDA but unauthorized disclosure of VII would definitely include civil penalties The Trade Secrets Act 18 USC 1905 could theoretically be used as a basis for criminal penalties but so far it hasn’t. I’m leaving out discussion of DoD specific rules since that is a whole different ball of wax. @Nonilex

@Nonilex @lawyersgunsnmoney Ok I’m familiar with the various flavors from the different agencies and communities. Has the government tried to enforce in court this new NDA in any particular case, or is it mostly a scare tactic at this point?

@meltedcheese Not that I’m aware of. Nonilex reported that the rule just came out. FWIW I think the NDA is a tool help their case when they go after people and may not be a substantive change to what is or is not a permitted disclosure.
