Request for a good #lawyer, ideally with expertise in #custody and marriage laws in #Spain as well as wellfare law in #Germany.

A female friend (German citizen) of mine lives in Spain in a broken marriage with a young child. She wants to leave her husband and go back to Germany with her child. Problem is she doesn’t currently have any income of her own, but at least a depression, if not other health issues, so doubtful whether she can support herself and her child financially on her own. The shared finances in the marriage are muddled.

The separation discussion has not yet reached a stage where things are only discussed in court, but she definitely needs some advice what her rights are and what agreements she can and can‘t make to be eligible for social benefits in Germany.

Any recommendations?

@cocoafrog Can’t help with that specific question, but my sister, who’s a lawyer in Australia that deals with child protection stuff, would yell at me if I didn’t mention the Hague Convention and its definition of “habitual residence”.

@justkwin thanks! Our understanding is that she cannot move together with their child without his permission, which gives him considerable power in the separation negotiations.

It’s gonna be challenging to dangerous to “just take the child with her”. I would definitely recommend a lawyer.

If they make it here and there’s not “abduction” stuff in progress, they should be eligible for social security. Which has challenges on its own, especially if she settles somewhere where affordable flats are not available.

I hope I reached some more knowledgeable than I am. @why_not might know some pointers?

Wenn sie das Sorgerecht hat und hier ist, haben die beiden Anspruch auf Sozialleistungen, aber es ist tatsächlich furchtbar schwer, eine Wohnung zu finden.

Wenn Du Sorgerecht und Pflicht hast und Deutscherstaatsbürger dann ist es SGB2 oder ich meine 9. Da sind beide vom SGB gedeckt.

Staatsbürgerschaft des Kindes? Sonst wird das eine Entführung.

Wohnungen mit Kind ist schwierig, wenn meine Tante oder Mutter was frei haben ...

Die gehen normalerweise zu den Mieterinnen (gibt auch paar Väter) nicht andersherum. Sprich die Vermiterin kommt.

Meine Verwandten suchen aktiv ihre Mieter nicht wie sonst andersherum. Also beim Frauenhaus etc

Nachsatz: Die Ämter sind da immer etwas kniitterich da 2 für sie mehr Arbeit bedeutet als 9 und es sind unterschiedliche Kostenstellen.
