New York: NYSoH announces federal approval to revert Essential Plan back to BHP authority

(March 23, 2026) - The New York State Department of Health provided an update following federal approval from the Centers for Medicare & Medicaid Services (CMS) of the State’s request to terminate its Section 1332 State Innovation Waiver and return to Basic Health Program (BHP) authority. The transition preserves Essential Plan coverage for approximately 1.3 million New Yorkers with incomes below 200 percent of the federal poverty level. The short version: New York's "Essential Plan" for low-income residents provides nearly $0-cost comprehensive coverage for ~1.75 million New Yorkers who earn between 138 - 250% of the Federal Poverty Level. Due to the GOP's #BigUglyBill, around half the funding of the program has been eliminated.
As a result, in order to preserve coverage for as many New Yorkers as possible, the state had to retool the Essential Plan back so that it only covers residents who earn 138 - 200% FPL...meaning that around 450K enrollees will be kicked off & will instead have to enroll via the ACA exchange.
Adding insult to injury, the GOP *also* let the enhanced tax credits to expire, which means those ~450K newly-uninsured enrollees, who have been paying almost nothing, will now have to pay between 6.6 - 8.4% of their income in premiums alone. For a single adult earning $39K/yr, that'd be $273/mo.
The state of New York is apparently working with insurance carriers to slash the deductibles for these 450K enrollees in half for the 2nd half of 2026 to help mitigate the blow to their finances (which I guess makes sense since they'll only be enrolled in the policy for half the year anyway).
