If the government does not want to pay damages, just label it an "emergency".
Farmers Ins. Exchange v. State of California (1985) 175 Cal.App.3d 494, 221 Cal.Rptr. 225 (Third Appellate District).
Damages arising from the exercise of the State's police power are non-compensable: spraying to abate a public nuisance (the Medfly), and damage to private property resulting from such action did not give rise to liability.
