By Friday night, the president posted on Truth Social that he signed an executive order enabling him to bypass Congress and impose a 10% tax on imports from around the world. “It is my Great Honor to have just signed, from the Oval Office, a Global 10% Tariff on all Countries, which will be effective almost immediately,” Trump wrote. Less than 24 hours later, Trump said he was bumping up the tariffs to 15% “based on a thorough, detailed, and complete review of the ridiculous, poorly written, and extraordinarily anti-American decision on Tariffs issued yesterday.”

For real, this is another mask-off moment. He had played up the tariffs as a game to push other countries around, but clearly and literally the only reason he is doing this is because he’s pissed off at the Supreme Court. It has fuck-all to do with other countries because it’s the same rate, worldwide, with no room for negotiations. He’s supposed to be this great negotiator of trade deals with other countries, yet he’s blowing up every single potential trade deal with a flat 15% worldwide because he’s pissed off at people in his own government.

If people can’t tell that he doesn’t give a flying fuck about anything except pushing people around, doesn’t matter who or about what, they’re fucking idiots. He’s just a cruel fucking asshole, like you said.

Only up to 15% and only for 150 days. After that Congress has to approve an extension.

That being said… I don’t know if there is any actual codified safeguard in it to prevent him from just stopping it and starting a new set again. I haven’t looked at the exact wording.

I think it’s kind of Legal? Smoot -Hawley from 1934-ish was never taken off the books. I cant remember if that’s the one he’s using for this, but it’s like that. There’s a never-used vestigial law that lets him do up to 15% for 150 days.

Here’s the thing. The constitution says CONGRESS levies taxes, not the president. Any law CONGRESS passes must be IN PURSUANCE OF THE CONSTITUTION. Making a law that abrogates any part the constitution is not IN PURSUANCE OF THE CONSTITUTION. The only way to do that is TO AMEND the constitution.

So, no. It’s not kind of legal.

There aren’t companies collecting the money. Customs and Border Patrol receives (paid for) goods, inspects them, charges a tariff, and releases the goods once the company who ordered it have paid the tariff.

A company has ordered something, paid for it, and receives a bill from CBP saying “pay this tariff or you can’t have the stuff you’ve ordered and paid for”.

For smaller packages that’s fine, FedEx etc. are allowed to pay the tariffs, then reclaim them for you (plus an admin fee you can get them to waive if you bug them).

It’s a different arrangement for commercial companies, but the end result is the same - CBP take the tariffs in exchange for the goods, whether they take them from the customer directly, or from a broker like FedEx.

I don’t doubt it. However;

  • If you’re acknowledging that he needs to cheat then we’re in agreement that he’s paying a political price for the tariffs and other unpopular policies. If what he was doing was working - politically - the cheating wouldn’t be necessary.
  • Cheating elections isn’t an on/off switch. The thing about putting your thumb on the scale is that it’s a lot easier, and a lot less obvious, when the balance is mostly equal. A thumb on the scale might pass without notice. A knee on the scale tends to get attention. The more votes there are against him, the harder he has to work to cheat and the more likely he gets caught.
