Friday's 6-3 ruling reflects an emphatic repudiation of a specific claim of delegated statutory authority by the Trump administration. Folks should be wary about reading it as more—or less—than that.

@stevevladeck.bsky.social I'm looking forward to reading this. I'll just say this case triggered me to ask, "How are tariffs supposed to be authorized?" I started digging, and ended up with this Yuge 1974 law, with updates, and can't make heads nor tails of it. There's a section where the OTR Secretary (a Cabinet post), decides what's "unfair" and is permitted to use tariffs to respond.

Obviously there's a reason that process wasn't followed, but I'd sure like to know why.
