TRO against federal agents use of force has been GRANTED!

There was a hearing today where a judge ruled in favor of and granted a temporary restraining order against the feds in Portland, OR using chemical weapons and excessive force after multiple lawsuits were filed after this weekend, including from a march of over 5,000 people on Saturday where young children got teargassed, and Sunday night where over 500 people protested at the ICE facility and without warning the feds gassed a large portion of the city.

The TRO blocks federal officers from using “chemical or projectile munitions,” including pepper balls, tear gas and other crowd control munitions “unless the specific target of such a weapon or device poses an imminent threat of physical harm to a law enforcement officer or other person.”

“In a well-functioning constitutional democratic republic, free speech, courageous newsgathering, and nonviolent protest are all permitted, respected, and even celebrated. The ruling also blocks federal officers from firing munitions or using weapons directed “at the head, neck, or torso of any person, unless the officer is legally justified in using deadly force against that person.”

“The temporary restraining order goes into effect for 14 days and could be renewed. Simon has scheduled a hearing on the underlying lawsuit for March 2, where he’ll take testimony from witnesses. That evidence could form a basis for an injunction should the judge deem it necessary.”

Whether or not they abide by it is another story and we shall see. In 2020 our local police were issued the same restraining order. They violated it immediately. These feds who were told they have “full immunity” by Vance have even less reason to abide by any orders
@alissaazar It’s clear that the judge tried to write the exception (“unless the specific target of such a weapon or device poses an imminent threat of physical harm to a law enforcement officer or other person”) as narrowly as possible, but I would expect ICE/federal forces to drive a full truckload of tear gas through that loophole.

@alissaazar yeah, and remind me again, how many of the police who were filmed doing it and bragged bout doing it faced any actual consequences?

Courts need to learn they're going to need to just start putting in jail indefinitely and refuse to let them out.

@alissaazar How does this differ from the previous prohibition against ICE using pepper spray and detention etc against peaceful protesters?
@alissaazar that "unless" is vague enough to negate the whole thing when "assaulting an officer" is thrown as a charge when the person an officer is beating gets their blood on the officer's uniform.
@vex yeah I really don’t see a reality in which this holds up. People have gotten those charges and accusations for sneezing within 6 feet of them. I imagine the biggest positive outcome will be liberals getting more radicalized and waking up when they inevitably disobey the judges orders but idk. Another positive was seeing the judge call their weapons pointed above peoples waists “deadly force” … but damn is the bar low.
@alissaazar The minute you add an "except" you might as well not have written a judgement in the first place. Every single instance will now "endanger the life of" for certain. These are total losers you're talking about. They're afraid of EVERYTHING. Especially about getting found out.
@alandvalonline they were already making outrageous claims before this. The other night when people were standing on the driveway they said people “stormed the building” and they regularly make it sound like it was sieged. They will do what they want and don’t even need a reason to try to justify it
