Under 5 CFR § 2635.202(b), "an emplovee may not, directly or indirectly, accept a gift given because of the emplovee's official position." This fundraiser directly violates that federal statute as it is raising funds explicitly because of the beneficiary's actions while on duty as an ICE agent, which makes him an emplovee of the Executive Branch Disbursement of these funds to the named beneficiary would violate federal law.

@Weirding_Is_Real Not only is the officer barred from receiving external funds for work he does for the government, section 6.1 of #GoFundMe's terms of service states that donations must be used in compliance with all applicable laws and regulations.

THIS is what should be cited when reporting the fundraiser: The officer cannot receive the funds without violating BOTH the law AND the GoFundMe TOS.

GoFundMe is obligated to follow their own TOS.

The thing that really blew my mind was learning that life insurance doesn't pay out of the insured dies during the commission of a crime. So, depending entirely on how the government frames this murder, her kids might never see a penny of life insurance. 😡

Well I tried repeatedly on two different browsers, and each time after tapping the submit button, the button would load for a few seconds, and then it would just go back to saying "submit" but be grayed out. No confirmation at all.. Idk if it even worked, but if someone else would like to try it for me, here is my paragraph, paste it into your report if you wish. (let's say it's licensed with the "do whatever the fuck you want" icense)



"Aside from the ethical problems of raising money to give to a killer whose self-preservation defense is dubious at best and whom did not suffer more than a bruise following the incident, this fundraiser actually violates federal law (and by extension, gofundme's ToS). From 5 CFR § 2635.202(b): "an emplovee may not, directly or indirectly, accept a gift given because of the emplovee's official position." GoFundMe's ToS, of course, requires donations to be handled in accordance with the law, but transferring these funds to the beneficiary would violate that law. It is also very possible that the actions of the beneficiary will be ruled as a criminal in the near future, as predicted by some legal experts based on the plentiful evidence available (4-6 recorded videos of the event). If this happens, it makes this fundraiser even more illegal because it would be fundraising directly for a crime. Endorsing a criminal act. And to be comprehensive, the success of this fundraiser could inspire more to act in the same way that the federal officer did. Perhaps they may expect to get donations, too.
There's probably something to be said about bad PR regarding platforming donations to someone who is perceived by many as a cold blooded murderer, specifically as a reward for the actions which are perceived by that same group as murder, not even for legal costs or medical bills. Although, that's going to be a conversation for GoFundMe to have internally. As a member of the public, I'd personally hope to see GoFundMe take action on this matter, if not for the sake of the increasingly ignored law, then for the good of the people."
