Delhi HC Mandates e-KYC For Online Domain Name Registrations

Delhi HC has ordered e-KYC verification for all online domain name registrations in India. The case stems from a civil suit that Dabur filed.

Yes, namesquatting is a big problem. But isn't that a trademark issue? Isn't that what the ICANN Uniform Domain Name Dispute Resolution Policy (UDRP) is for? It doesn't even look like the court needs to get involved. But if disputes still persist, why not just create a liaison with the ICANN to resolve it?

Why instead give carte blanche to 'enforcement agencies' to pull up needlessly sensitive information of the domain owner? Why deny the worldwide default privacy protection?

And will any of this red tape actually solve the namesquatting problem? What about domain registrations abroad? Especially with the ones that allow anonymous payments with crypto?

This isn't to stop namesquatting at all, is it? This is going to end up as yet another snooping tool, isn't it? #Creeps!

And thank you for creating unnecessary headache for those who register domains abroad legitimately - like for I don't know,... THERE NOT BEING A HALF DECENT REGISTRAR AROUND!

I have a feeling that the court involved is taking too much advantage of the unaccountability and inscrutability of their authority. However, I can't say I'm too surprised, considering this court's terrible order in a horrific case, that the top court stayed today. Perhaps that one provided the cover for slipping another one through?

@goku12 here's a tin foil hat theory, I wonder if the revolutions in Nepal and Bangladesh is getting to them, hmmmm 

@hariprakashj Why? Do they want a revolution here too? Regardless, how is a court taking such a decision, much less an HC of a UT?

Such decisions are serious, complex and specialized enough to be legislated in an assembly of representatives in public view. Or are we past the stage where making laws no longer requires a democratic process? Such overreach of authority without any resistance is a serious issue in itself.

@goku12 I dont know why they are going so Orwellian on these things now, there was the circular to install that spyware app, the discussions going on now to force enable A-GPS on phones without a way to disable it and also the caller ID was made mandatory. The ID is picked up from the KYC docs and displayed to anyone who you call, this works on Jio 5G afaik, if you force it into standalone mode. I can see the names of the people who call me if they are on Jio too. Lots and lots of creepy stuff.
