A super-militarized ICE is getting more and more violent. After assaulting a musician playing the theme from “Ghostbusters”, ICE took her out of Oregon, to Washington state, where she remains in jail. https://www.independent.co.uk/news/world/americas/crime/portland-ice-clarinet-arrested-protest-b2845329.html 1/
Musician playing ‘Ghostbusters’ outside ICE facility is arrested by agents: ‘Why are they targeting a clarinetist?’

‘Taking us citizens out of state to detain them without charge is a new action from the Feds and should be opposed,’ her band said

In Chicago today, federal agents intentionally rammed a car they were pursuing, causing the car to crash. The agents tear-gassed protesters who gathered at the scene of the crash. Do review the photos in this excellent reporting from Chicago Sun-Times. https://chicago.suntimes.com/immigration/2025/10/14/crash-involving-immigration-agents-in-east-side-leads-to-tear-gas-detentions 2/
Feds ram SUV after chase down residential street in Chicago, then tear-gas crowd

The crash happened late Tuesday morning near 105th Street and Avenue N in the East Side neighborhood. Two men being pursued were arrested as were two bystanders. The crash drew dozens of neighbors who protested the tactics of immigration agents.

I’m sure that the Trump regime will soon invoke the Insurrection Act, despite the fact that it is the proximate cause of the violence it will use to justify doing so. 3/
Here’s what is significant about the Insurrection Act. It temporarily suspends the Posse Comitatus rule and allows the president to deploy the military to assist civilian authorities with law enforcement. See https://www.law.cornell.edu/uscode/text/10/252. 4/

Don’t be misled by the benign sounding “assist with law enforcement”: once in U.S. cities under the Insurrection Act, federal troops will occupy those cities. 5/
Both the language of the Insurrection Act itself and Supreme Court precedent interpreting give the President tremendous latitude to invoke the Act at his or her discretion. https://www.brennancenter.org/our-work/research-reports/insurrection-act-explained 6/
The Insurrection Act, Explained

The vague and rarely used law gives the president broad power to deploy the military domestically — but it’s not a blank check.

There are possible grounds for challenging Trump if he does invoke the Insurrection Act. You can get a good idea of these here. https://protectdemocracy.org/work/legal-challenges-insurrection-act/ But the ultimate success of these is unlikely given the commitment to affording Trump power the Roberts Court has demonstrated. And of course along the way the Trump regime will run to the Roberts Court to stay any restraining orders issued by lower courts. 7/

In any event, even if the Roberts Court were to permit a lower court to invalidate any invocation of the Insurrection Act by Trump, by the time that happens, federal troops in U.S. cities will likely have wrought even more violence then federal agents already have. 8/
There’s no decisive way to ward off Trump invoking the Insurrection Act. As I noted in the earlier posts in this thread, the Trump regime is manufacturing the violence it will use to give itself political cover to do so. One thing people should NOT do is stop protesting. 9/
In fact, massive nonviolent protests are perhaps the only way to make it clear that it is politically unacceptable for Trump to use the Insurrection Act to put troops into Portland, Chicago, and any other places ICE is needlessly causing chaos. This is why it is imperative to show up at a #NoKings protest this Saturday, October 18. Go to https://www.nokings.org/ to find the one nearest you. 10/10
No Kings

As the president escalates his authoritarian power grab, the NO KINGS non-violent movement continues to rise stronger. We are united once again to remind the world: America has No Kings and the power belongs to the people.

@heidilifeldman Look in the Epstein Files. The answers lie there.
@heidilifeldman Good thread. But I gotta say, it’s kinda f’d up that the law.Cornell.edu web site is showing me ads for lawyers in my area. DUI lawyers and such. Can’t major universities’ websites stand on the merits of their institutions?
@MarkBrigham Cornell doesn’t fund LII, though it provides resources like hosting the site. More info at https://about.law.cornell.edu/2024/11/21/why-does-lii-ask-for-donations/

@heidilifeldman

#Trump wird alles plattmachen, was sich ihm in den Weg stellt. Im Landesinneren.
Und im Außen gibt er den Friedensstifter.
Völlig pervers.

@heidilifeldman
Yes, Chigago SunTimes:
“[The 15 yr old bystander US citizen, after being thrown to the ground] was then transported to a federal law enforcement facility not affiliated with CBP or ICE, where CBP agents held him, handcuffed, in the back of a vehicle in a garage—never booking him, never reading him his rights, never stating why he was detained, and never allowing him to contact his mother”…

@heidilifeldman

It is violence with the aim of intimidation and triggering fear. Violence licensed by the current Administration that is turning against its people. It is how fascism begins. And it is not as if Trump is not signaling its validation.

@heidilifeldman I'm frustrated at the author's use of the word "battleground" to describe the location, since that only feeds the narrative coming out of DHS.

@heidilifeldman My fear: they will seed peaceful protestors with gunmen who will murder a few federal agents to justify enforcement opening fire on the protesters.

Standard authoritarian playbook. Extremely effective at making peaceful protesters stay home. We've seen it happen so many times in other countries over the last century, never thought I'd one day fear it in the US...

@heidilifeldman

what the actual fuck 😳🤬🤬🤬

@heidilifeldman how many people will be taken and disappeared before you act americans? It's happening right in front of your very eyes

@heidilifeldman

the far right has no sense of humour, that is the problem. Which means everything becomes a personal attack on their VERY important selves.

@heidilifeldman “Why are they targeting a clarinetist?” I guess it’s because of the ingrained misogyny on the right.

I just hope that USians will remember Dem inaction when this could have been stopped, and Dems voting to honor Kirk, and Dem leadership playing nice with the fascists. Both mainstream parties need to be burned to the ground and a party that reflects democratic principles needs to rise from the ashes.
