MAGA: The right to guns is cannot be touched as it’s in our constitution! (Not what it actually says). It’s the 2nd amendment!
Also MAGA: Let’s just change the 22nd amendment so Trump isn’t limited by the rule specifically created to prevent dictators.
To everyone: They have stopped listening so don’t let them tell you to shut up.
These two have the same legal value.
“A well regulated Militia being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
The aim of it is a militia to protect the state. The National Guard is the State’s army and it could be argued entirely meets the second amendment. Under that argument you could ban guns.
I’m not saying you should but that you could. The second amendment is far from saying everyone can have machine guns although I do accept that it leans that way.
The knock on conclusion is that it can only be interpreted and therefore the Supreme Court is political. Furthermore the idea it is apolitical is a fiction.
We know this, this is just the logic.
