I need more friends who are willing to go trespassing with me
All I ask is that you are willing to go onto private property with me, despite the risk of getting caught, and that you keep cool if we do get caught.
@MLE_online you'd be so disappointed if you do this in Austria. trespassing by itself is simply not a crime here.
@elexia I don't see how that could possibly be workable. If i walk into your house and you tell me to leave and i say no and stay there, I'm not breaking any law??
@MLE_online getting into someone's living space without permission would be illegal, but this doesn't extend to just any piece of land.

@MLE_online not a legal expert. there are certain limitations. but just something being property doesn't make it illegal to enter. there's the concept of Besitzstörung "disruption of property" for example. you're not allowed to inhibit someone's use of their property. say by blocking access to a driveway with a car. and yes intruding on their privacy in their home (this includes your landlord; they cannot enter your home without permission).
so it's not that everything that would be covered by "trespassing" in places where that concept exists would automatically be legal here, but rather that that legal concept does not exist here. other legal constructions do, so some specific cases of what elsewhere might be "trespassing" might be illegal, though some of those might also be additionally covered under other legal concepts anyway.
@elexia that makes sense. I'm sure the practical outcome of the laws would still be that I would get in trouble for sneaking into a quarry that wasn't open to the public
@MLE_online maybe. if it's clear that you aren't allowed to enter.
@MLE_online idk if you're not disrupting any operations it might be hard to bring a case for Besitzstörung. especially if the owner/operator isn't there to tell you to leave. what are they going to sue you for?
@elexia I have no idea how Austrian cops behave but I know here there is always some law they can get you for if they can't get you for the thing they want to get you for. I can barely imagine what it would be like to live in a place that's not like that
@MLE_online I mean cops are bad but they aren't quite incentivized to get at many people arrested and convicted as they can. doesn't mean they won't act badly still, but it's not the same systemic push for mass incarceration.
@MLE_online what you look like and the language you speak is gonna really impact your experiences with the police. a lot of cops are just fascists.
