@mattblaze Do you actually believe the US constitution remains relevant? The Weimar constitution stayed on the books right through WWII, but was essentially ignored.
@robpike @mattblaze the Weimar constitution was used by the Nazis to gain power, so certainly it was relevant, at least until the Reichstag abdicated power with the Enabling Act. Before that it was Article 48 of the Weimar constitution that allowed dictatorial power by decree. The US constitution is stronger, even if our institutions are currently weakened. There are lessons in Weimar, but I don't think the lesson is that constitutional law is irrelevant.
@robpike @mattblaze To this day the constitution of China guarantees freedom of speech and the rule of law. But trying to invoke that gets you arrested.
@robpike Yes, I do. We got through the first Trump administration badly damaged but probably not irreparably so. The next Trump administration will be a much harder test, and I’m frightened for what they have in store, but I’m more frightened of the prospect that people simply give up out of a sense of hopelessness.

The Supreme Court has *already* declared the president beyond the rule of law. Specifically to nullify prosecution for a coup. They even gave Trump more immunity than his lawyers were asking for.

Their justification *is* the Constitution. Their ideological allies have campaigned for decades to mainstream that interpretation

The Constitution is not neutral or self-executing. Code is a poor metaphor
