Trump’s Sentencing in Hush Money Trial Is Delayed Until After Election Day

The decision by Justice Juan M. Merchan means voters will be left in the dark about whether the former president will face time behind bars.

The New York Times

The judge overseeing Donald J. Trump’s #criminal case in Manhattan postponed his sentencing until after #Election Day, a significant victory for #Trump as he seeks to overturn his #conviction & win back the White House.

In a ruling on Fri, the judge, Juan M. #Merchan, cited the “unique time frame this matter currently finds itself in” & rescheduled the sentencing for Nov 26.

#Merchan had previously planned to hand down Trump’s punishment on Sept 18, just 7 wks before #Election Day, when #Trump will face off against MVP #KamalaHarris for the presidency.
“This is not a decision this court makes lightly but it is the decision which in this court’s view, best advances the interests of #justice,” Justice Merchan wrote in the 4pg decision, which noted that “this matter is one that stands alone, in a unique place in this nation’s history.”

While the decision will avert a courtroom spectacle in the campaign’s final stretch, the #delay itself could still affect the #election, keeping #voters in the dark about whether #Trump will eventually spend time behind bars.
It is unclear whether sentencing Trump in Sept would have helped or harmed him politically;his punishment could have been an embarrassing reminder of his #criminal record, but could have also propelled his [#BS] claims [#lies] of political martyrdom.

Justice #Merchan’s decision came at the request of #Trump, who had asked to #delay the sentencing until after the #election, partly so he had more time to challenge his #conviction. Prosecutors working for the Manhattan DA, #AlvinBragg, who brought the case, had deferred to the judge, paving the way for at least a brief postponement.

The judge’s decision to push the proceeding is likely to infuriate Bragg’s liberal supporters & fuel accusations that #Trump is above the #law, shielded from the consequences of conviction, unlike any other #felon. To avoid that impression, left-leaning legal scholars — & Trump critics seeking catharsis — wanted Justice #Merchan to hold Trump accountable promptly after he was convicted in May of having #FalsifiedBusinessRecords to cover up a sex scandal.

@Nonilex

Since elections are fueled best by outrage... it's probably smarter that it is left-leaning voters who are outraged by the lack of legal justice, and so will be more motivated for justice at the ballot box.

A prison sentence for what the right deems as a minor paperwork violation, would similarly fuel Trump voters to turn out to the ballot box to seek their own sense of justice.

@chiclet @Nonilex that’s certainly a glass half full view!

@JonChevreau @Nonilex

I prefer to think about dynamically flowing water, rather than a static glass.

The ideal outcome is not for a quick sentencing in NY, but a longer sentence of prison time, to take place AFTER federal trials for classified docs and trying to overturn the election. That way, when the next Republican president tries to pardon his federal crimes in 2029 or 2033, he'll just go straight to state prison.

@chiclet @JonChevreau @Nonilex Nice example of flip-thinking (omdenken).
I hope you're right.

@ericschutte @JonChevreau @Nonilex

It's strategic thinking. It's probably the reason why Bragg didn't object at all. And why Merchan did it (neither are friends of Trump).

If you're playing checkers, it's not obvious. But when you are playing chess, sacrificing a pawn for a better position against the King, it is pretty obvious and a standard play.

Any move that could help Trump win the election, no matter how remote the possibility, has to be considered.

If Trump wins, all federal prosecutions will go away. And even the NY state convictions become voided, as they will not be able to incarcerate a sitting president. And it will likely get deferred to federal, like he's trying to do now, and never face this conviction at all.

@chiclet @ericschutte @Nonilex Well if the Felon wasn’t already 200% motivated to win the election at any cost, this just adds to his motivation and desperation. Even more inclined to cheat, I’d say. And even more motivated to cry stolen election again if Kamala wins.

@JonChevreau @ericschutte @Nonilex

I don't see that. He still has some hope it'll be a light sentence.

But even he himself is plenty motivated, he could not convince voters to be outraged on his behalf until the sentence is public.

@chiclet @ericschutte @JonChevreau @Nonilex Ain’t life grand when you are DJT! Immunity! Grrrr

@chiclet @Nonilex

No.

That’s the wrong message…

I want to participate in a system THAT WORKS.

The messaging right now is “shits broken, here - patch it with this quick fix (voting)”

What’s broken is deeper than voting. Voting is not what fixes the system. Voting perpetuates the system.

National ranked/rated choice is the only sane and rational voting method I’ve come across. This electoral college bullshit is giving disproportionate rights to land owners.

@altruios @Nonilex

Totally agree.
I hope you're writing to your state legislators about RCV.

People can walk and chew gum at the same time. People can and should do both, vote and advocate for RCV. Voting is at least harm reduction.

Although it doesn't immediately fix the systemic problems, voting still the most effective expression of power (way above protesting) that we have. Not voting ony helps the oppressors.

@chiclet @Nonilex

doing both is a bare minimum to enact change. real change comes from money exchanging hands in the right/wrong way.

It is our moral obligation to make fascism as unprofitable as possible. That means actively causing profit loss of fascist leaning corporations as quickly as possible. taking away their power (money) is how to stop a fascist uprising. vote away, but the fascists have guns. votes don't matter if the other side will shoot you regardless of the outcome.

@altruios @Nonilex

Okay, you try the boycott way.
We'll try the voting way. We'll see which is more effective.

@chiclet @Nonilex

Did I say boycott?!?!

Boycotting is protesting.

I am talking about something more 'effective' than protesting.

@altruios @Nonilex

Good luck with that. I don't want to know.

What I do know is... that they've got more money than bullets and way more money than voters.
While you're playing whack-a-mole with endless coffers of Russian oligarch gold,... we'll be voting and winning with shear turnout of voters that are focused and motivated instead of apathetic and distracted.
