#LegalEthics Tidbit: Do I need to tell my clients I’m using generative #AI tools in my practice?

ABA Opinion 512 opines that it depends on the particular tool and use. For example, lawyers should consult with the client before inputting their info into an #artificialintelligence tool, when it will impact the fee, when it is relied on for important decisions, or when the client asks.

@dkluft I don't see why uploading to AI robot would be any different than sending to a client's Gmail account or anywhere else it could be parsed, and suspect the informed consent barrier here is therefore quite low, basic engagement letter stuff.. not because it should be, but because the contemporary "reasonable lawyer" lacks appropriate tech competence.

But then, I have the luxury of being out of practice. Curious to see where the mainstream goes.

@ben Agreed some of the same risks are present, which is why the ABA elsewhere has advised similar - but not identical - precautions with regard to sending client information via unencrypted email over the internet. See Formal Opinion 17-477.
