Engoron remarked that they're often referred to as a "gaggle" of photojournalist, a word usually used to describe "geese," he notes.

Wallace's questioning begins with Trump's corporate structure and his personal beneficial ownership of it.

Asked whether he formed the Donald J. Trump Revocable Trust when he ran for president in 2016, Trump said: "Pretty much when I won, I formed the trust."

Asked about Donald Trump Jr., Trump says: "He’s a hardworking boy," and then corrects himself, "young man, and he’s done a very good job, as has Eric."

Trump confirms he is owner of all assets in the Trust & the beneficiary thereof; he says around the time he won, he moved the Trump Org into the trust to avoid conflicts of interest, although he maintains that he could have had two desks as Washington did. 3/

He made Weisselberg a trustee because he had been with the company for a long time; he did a good job; and we really liked him. As for Don Jr., he was named as a trustee because he is a “good boy, or man and an honorable one.”

13/ Rubin:

Trump testified that in 2021, he restored himself as sole trustee of the Trust because he figured he’d be back in business until he decided to go back to politics or do whatever he had to do.

Now Wallace is asking Trump why he removed himself again as the sole trustee as of July 7, 2021. “I think we had a position where I was gaining more and more confidence in my family.

Trump insists that his marquee properties were "underestimated," like Mar-a-Lago, 40 Wall Street, Doral and others.

Trump falsely claims that the judge estimated Mar-a-Lago was worth $18 million. (Engoron didn't; he cited an appraisal of the property from 2011.)

Kise faults Wallace for his open-ended, wide questions, suggesting they are inappropriate for trial, as opposed to at a deposition. Wallace is frustrated, but moves on.

21/ We’re now looking at the description of Niketown’s value in the 2014 statements of financial condition, which is, according to the statement, based on an evaluation by Trump in conjunction with his associates and outside professionals.

Asked whether he agrees with the statement, Trump does not take issue with the description of his involvement; he disputes that the value was $348 million as of June 30, 2014, given the location of the asset (between Tiffany and IBM).

22/ Wallace tries to pin Trump down: Has there been a change of value since 2014? Trump says it’s a “holdup asset,” and its real value is for Tiffany or IBM to purchase.

(The statement says the value was derived from the cash flow derived from the net rental stream, not its sale value to the potential purchasers.)

Judge: Control your client.

Lawyer. No. You do it.

That's absolutely contempt of court in the ordinary English sense of the phrase, and it could well be in the Legalese sense too. "Could you control your client?" may be phrased as a request, but it's really an order, and Kise just refused to obey it. This isn't going to end well for him. 🤞

@GottaLaff and why he doesn't censure Kise right there and then for that answer is beyond all of us. It's going exactly to plan. Trump will use his appearance to campaign and smear. Engeron will keep looking to counsel. Counsel will say "I can't do anything" and so the circus that can't deal with a demagog will go on and on.

@GottaLaff If there had been a jury, bringing up the previously rejected "worthless statement clause" defence might have been basis for a contempt of court ruling. But, for better or for worse, this doesn't apply in bench trials, at least not with the same immediacy.

Which leads me to wonder why Kise isn't up on his hind legs yelling "objection, relevance," since, while the question of whether Trump knew he lost is highly relevant to the DC action, it's not clear to me how it's relevant to this one. This one is about inflating asset values. But good for the government for getting him on the record on this.

@GottaLaff It should be pretty easy to goad him into going off the rails. Something along the lines of "do you not see the financial statements because you can't understand them?" or "would you be able to understand them given you were unable to understand whether you'd won an election or not?"
