Breaking news: Brazil makes homophobia punishable by prison 🗞️

In an almost unanimous vote, the Brazilian High Court has ruled today that homophobia can now be punishable with a prison sentence

This is a huge win for the LGBTQ+ community in Brazil that needs to be celebrated 🇧🇷

The 9-1 vote ruled that homophobic slurs and hate speech are a crime, similar to other forms of hate speech, such as racism.

The lead judge, Justice Edson Fachin, described this ruling as a ‘constitutional imperative’ to provide LGBTQ+ Brazilians legal protection.

While back in 2019 the court had previously ruled homophobia as a crime, it only applied to the LGBTQ+ community as a whole and did not cover hate crime attacks on individuals. Last year, Brazil also elected two trans women to the national congress.

Brazil is unfortunately one of the most dangerous countries for LGBTQ+ people in the world, in particular for the trans community. In 2022 alone, 228 LGBTQ+ people were murdered – this is only the number of deaths that were registered.

Therefore this win has significant importance for the country and its LGBTQ community, and is another positive step in the right direction 🙌

but for example, homophobic jokes are still considered homophobia
comedians used to just get a fine (and turn that into a joke and make the money back lul), now they'll just get thrown in prison

@GenderGP Wow, this is such a turnaround from how things had been going in Brazil that I had to read it three times to understand this was good news. Now, the former President of Brazil could be arrested for the kinds of inflammatory anti-lgbtq statements he made in office, if he isn’t arrested first for vote tampering, insurrection, or running a counterfeit watch ring.
