I don't know their financial situation or risk tolerance, but I felt they had Fox over far more of a barrel than that -- especially with brand new claims of Fox hiding information from discovery.

@EmilyGB @Popehat Trials are inherently unpredictable. You can ask for eleventy billion dollars in a complaint but that does not mean that you are going to get anywhere near that much. A settlement that large combined with a ruling that the 2020 election claims were false is a huge win for Dominion. Dominion was never going to get enough to bankrupt Fox, and settling for hundreds of millions was probably a no-brainer for counsel.
@jayreding @EmilyGB @Popehat If I read FOX’s annual report right, the settlement is 65% of their net earnings from last year. And that’s before SmartMatic gets their chance at bat.

@EmilyGB @Popehat If I were going to guess, I would guess they figure that (a) actual malice is a tough bar to meet; (b) even if they win, getting a judgment for $1.6bn is far from guaranteed; (c) what has already come out in discovery is hugely damaging to Fox, and also (d) will be used in the *other* lawsuits going on against Fox; so all in all (e) getting half of what they were asking for and walking away is a pretty good outcome.

$787 million is enough to make at least two Marvel blockbusters. Almost two Endgames.

This might not be the crushing verdict we wanted, but maybe it's the devastating financial loss Fox needed. Getting half of the requested damages shows how desperate Fox was to settle.
