Kidnapping to be legalized in Florida | Terms and conditions apply.

Florida courts could take 'emergency' custody of kids with trans parents or siblings — even if they live in another state.

A proposed bill making its way through the Florida State Senate would allow the state "emergency jurisdiction" over children who receive or are "at risk of" receiving gender-affirming care — or if their parent receives it themselves.

Senate Bill 254, introduced Friday by State Senator Clay Yarborough, would grant the court authority to take emergency custody of kids under the same statute that protects them from domestic violence and abuse.

The state could take temporary custody of children if "it is necessary in an emergency to protect the child because the child, or a sibling or parent of the child" is "at risk of or is being subjected to the provision of sex reassignment prescriptions or procedures," according to the proposed bill text.

The proposed bill defines sex reassignment prescriptions or procedures as hormone therapy, puberty blockers, and surgeries or procedures that "affirm a person's perception of his or her sex if that perception is inconsistent with the person's sex" at birth.

The court would also be granted "jurisdiction to vacate, stay, or modify a child custody determination of a court of another state to protect the child from the risk of being subjected to the provision of sex-reassignment prescriptions or procedures," according to the proposed bill text. "The court must vacate, stay, or modify the child custody determination to the extent necessary to protect the child from the provision of such prescriptions or procedures."

Last month, Florida Governor Ron DeSantis requested public entities, including hospitals and universities, provide a breakdown of the medical data of patients who received gender-affirming care at their institutions. Students from public universities walked off campus in protest.

The state has seen an increase in anti-LGBT bill proposals and laws in recent years, including DeSantis' controversial "Don't Say Gay" bill, which limits how teachers may instruct about sexual orientation and gender identity.

The bill goes even further to violate interstate comity by authorizing the courts to vacate child custody determinations of other courts only if the child is trans. This is a greenlight to transphobic family members to engage in state sponsored kidnapping.

A transphobic parent could kidnap their trans child in violation of custody agreements and abscond to Florida and be protected by Florida law under this despite likely committing felony kidnapping in their home state.

The bill goes even further to ban all public funding for gender affirming care, including for adults. This would mean state and local employees and their families would be barred from coverage for gender affirming care.

Between this and other bills introduced today, gender affirming care would be banned for all trans youth, and coverage would be eliminated for all state and local employees and their families. All public hospitals are banned from providing gender affirming care, including adults.

An additional bill requires "informed consent" forms by the state filled with pseudoscience and and bans telehealth for gender affirming care for adults. It also bans changes to gender markers on state issues birth certificates for all trans people.

This is a full on war against trans people in the state of Florida. This is a full elimination of recognition and a limitation on access to care for all trans people, including adults.

And before the trolls come in and say "but California did it!" No they didn't. SB 107 required that California be the home state. It follows widely accepted requirements under established precedent around custody laws.

@unearth It always fascinates me that the right-wing media has been pushing the "the left is coming to take away your kids" message for decades now, with not one single piece of legislation ever proposed by Democrats that would ever do such a thing.

Yet constantly, we have legislation proposed by the RIGHT-WING, like this one, to do exactly that. Constantly.

They talk about it because they're the only ones that think about the possibility. The left never actually thinks about such things.

@unearth Since it would be enough for the child to be “at risk of receiving gender affirming care” and a parent essentially being trans is considered “a risk”, this will also be used in custody disputes between cis people.

Custody disputes are often ugly and if someone thinks they will be likelier to get custody if they falsely claim their spouse is trans and has been talking about transitioning… well, that will happen before long. I wonder what level of proof the Florida courts will require 🤔
