The OSS model is significant and much needed.

Important to emphasize:
Patented seed is almost always _agricultural_ seed, for crops grown at large scales.

In the US, at least, "the vast majority of garden seed varieties--including heirloom and historic varieties, most hybrids, and many modern open-pollinated varieties--are not protected under any of the various forms of intellectual property protection."
