For this weekend's blog post, I did a deep dive into the Georgia investigation.
https://terikanefield.com/the-georgia-criminal-case-against-trump-and-his-pals/

I haven't written about it for a while, and with Lindsay Graham about to testify, I thought this would be a good time to do a deep dive.

I am still trying to get comfortable with Mastodon so if you have a question about the blog post, the best way to ask is to leave a comment. I see all the comments and as long as you're polite, I will answer 😉

The Georgia Criminal Case against Trump and his Pals - Teri Kanefield

The big news this week was that Merrick Garland appointed veteran prosecutor Jack Smith as Special Prosecutor overseeing the January 6 probe and the investigation into the Mar-a-Lago documents. Garland skeptics celebrated because they understood this was a clear sign that this investigation is leading toward major indictments. If you’ve been reading this blog, you’ve

@MsStarryNight try clicking not on the blue link when it first appears in her toot, but on the preview all the way at the bottom of the toot. That worked for me.

@Teri_Kanefield Oh but clicking on the preview graphic at the bottom of your post did work! So I’m good.
@Teri_Kanefield nor me. But I don’t understand how #Trump can call an official ask him on the recording to “find” him extra votes and not be immediately arrested. I get that the case needs to be thorough and prepared but it does seem to be taking an inordinately long time.

@Jemesa Hi, James.

Did you read the blog post? I actually address your question in depth.

@Teri_Kanefield well, no, because the link you posted didn’t work. But I note you have fixed it, so I will.

@Teri_Kanefield
Thank you for all your time & patience in explaining the law for us. You help to make all of us better educated & we’re grateful 🙏
@Teri_Kanefield I may have missed it, but I am curious whether Sidney Powell will be prosecuted or disbarred for the actions in Georgia? By the way, I sincerely appreciate your efforts to educate the public regarding these important legal matters.

@Teri_Kanefield The timelines you provided are very, very helpful. And I understand more about what you think DJT might try to use as his defense arguments, and why they probably won't keep him from being indicted in #Georgia.

One question is, would it be typical for Fanni Willis to wait until all the witnesses requested by the grand jury have responded to their subpoenas before asking the jurors to vote for an #indictment? Or could they decide based on partial testimony that it's time?

@mscitizen

See the FAQ page on my blog for the DOJ investigations. I actually answer your question there.

It's a sticky on my blog. I should put it as a sticky here, too.

It is prudent to get all the evidence first.

@Teri_Kanefield

OK I was skeptical about reading the FAQ, because I asked a question about Fani Willis, who is the district attorney for Fulton County, Georgia, and you sent me to read a really long document about Merrick Garland and the federal Department of Justice.

1/2

@Teri_Kanefield

But I read your FAQ
https://terikanefield.com/all-new-doj-investigation-faqs/

and it did explain your recommended approach for investigation and prosecution.

Notably, you state "Good prosecutors don’t rush to trial before they have all the evidence and a firm understanding of exactly what happened."

So I can infer that you think it would be wise for Fani Willis to wait until all the people subpoenaed by the Fulton County Grand Jury actually testify.

Do I get brownie points for reading the whole FAQ?

@Teri_Kanefield FWIW, on some versions of the Mastodon software you can edit your post to correct the link.
@Teri_Kanefield ok, the new link definitely works. The point for me, is who decides whether Trump did or did not solicit election fraud by requesting an official to “find” him extra votes? I assume this would be a question for a jury, who would understand the context of the election, the big lie, see a motive and hear the tape. I really don’t see this as complicated. The tape exists - we’ve all heard it.

@Jemesa

Yes, in our system of law, a grand jury / prosecutor makes a charging decision and a jury acts as a fact finder.

@Jemesa I forget that my audience include people who are not Americans and are therefore not familiar with how our legal system works.
@Teri_Kanefield ok, so the decision of guilty / not guilty would be for the Jury. The tape exists. #Trump is asking the official to “find” him extra votes, so why can’t he be charged and the question of intention/guilt/innocence be left to a Jury? I don’t understand from your deeper dive why there’s a delay or apparent reluctance to charge/indict.
@Jemesa @Teri_Kanefield there's a delay because many support his effort. Enough to tip the scale

@Jemesa

Read my FAQs. It's a pinned on my blog.

@Teri_Kanefield @Jemesa others should also be aware that grand jury in US is usually mostly white retirees as those are the ones most often able to spend weeks or months with little or no compensation and this dynamic drives charging decisions for racially discriminatory outcomes.

@Objkshn @Teri_Kanefield i think you’ve raised a key point, because I expect if a black man (Obama for example) had lost and done the same thing as #Trump they would have been a much faster and decisive response. I appreciate the detailed look at why it’s taking so long to get the legal case right - but it’s just delay and obstruct.

Of course #Obama and #Trump are nothing alike (Obama was a winner), but can you imagine if he’d incited something like the #CapitolAttack ?

@Jemesa @Teri_Kanefield

Minorities and marginalized get wrongfully prosecuted while the privileged corrupt white men get shielded to avoid any accountability, by design of a system run by the white people for the white people.

@Objkshn @Jemesa

This is what I call a "rage-inducing simplification" and I disapprove for lots of reasons.

I'm also a criminal defense lawyer (appellate, practice limited to indigents) and I know what you mean, but I believe on social media we must strive for absolute accuracy.

I deal with that one here:

@Teri_Kanefield Welcome to Mastodon Teri. 😊
@Teri_Kanefield how much wood could a woodchuck Chuck if a woodchuck could Chuck wood?
@Teri_Kanefield for the record I was pretty polite but didn’t get an answer.
@DrMartenz Did I approve your comment?
@Teri_Kanefield im not sure what that means. I was just testing to see if you’d respond, cuz I don’t think you would have on Twitter. So now I’m content

@DrMartenz
This account is much smaller!

On Twitter there is really no way to see all of my mentions, so I doubt I was ignoring you :)

The easiest way to ask me a question is to leave a comment on my blog post. Sometimes people email me, but I've lost emails there too

I have my blog set up so that I approve all of the comments.

@DrMartenz @Teri_Kanefield Don’t be a pest. Your question was not related to her blog post but intended to deflect and detract. Any graciousness she extended was in excess of your entitlement thereto.
@Teri_Kanefield A good explanation, very helpful.
Does the fact that Trump is now a declared candidate for office change anything with this investigation?
@PaulTheFossil
It may have been part of the reason for appointing a Special Prosecutor, but if we take Garland at his word, it will not change any charging decisions.
@Teri_Kanefield This is excellent. TY! I appreciate you laying out the timeline.
@Teri_Kanefield There was a trump tweet too, btw.
@Teri_Kanefield @trcfwtt
My Rep, Rob Wittman, one of the 147 to vote against certification on 1/6, seems to have been openly, gently giving a nod to the false electors plot just days later. He was just re-elected.
@DefiantJZ @Teri_Kanefield One of the things Eastman said during his testimony before the Georgia Legislators that never got fleshed out was that Florida was prepared to send their own slate of electors. Since trump won Florida ppl forgot about it.
@Teri_Kanefield Another terrific blog post. Thank you.
