Must-read and very insightful piece about how Twitter was structured to benefit from the one stop shop, and how it’s plunging out of compliance with that and everything else data protection related. Get out the popcorn for the @CNIL, AEPD, and others getting their hands on Elmo. https://techcrunch.com/2022/11/14/is-elon-musks-twitter-about-to-fall-out-of-the-gdprs-one-stop-shop/

@tjmcintyre @CNIL Basically he’s utterly screwed and out of his depth.
@DaraghOBrien @tjmcintyre @CNIL wish I had seen your post before I went and read the whole article.
@DaraghOBrien @tjmcintyre @CNIL Well, yes, but he's been that way for a while, this time he might actually have to pay for it like any other person.
@tjmcintyre @CNIL the essence is: if decision making power at Twitter no longer exists in Ireland but in the US with Musk or his team, the OSS no longer applies. In addition, given current decision making, the urgency clause may also kick in to give national DPA the opportunity to apply their competence directly. Yet: expect EDPB to consider setting up a task force, potentially not led by Irish DPC. Yes.
@simonhania @CNIL Good point re the urgency exception allowing other regulators to wade in. Regarding decision making, you might be interested in this thread in which @FCrehan and I differ: https://twitter.com/Fergal/status/1592478680324124673

“@LizCarolan This is a bit of a stretch. Even if Ireland ceased to be main establishment (doubful, imo) the DPC would simply be replaced as lead regulator by the regulator of the new main establishment, not by every other regulator across the EU”

Btw this is interesting judgement by Conseil d'Etat regarding CNIL and main establishment in relation to urgency. Contrary to popular belief CNIL is not always looking to exercise competence in cross border cases, "bypassing" a lead SA. https://www.conseil-etat.fr/fr/arianeweb/CE/decision/2022-04-26/449845
