The ruling by Judge Veronica Nelson means the Harris County District Attorney’s Office must re-file the indictments and again present the charges to a grand jury, appeal Nelson’s ruling to an appellate court or drop the murder cases altogether. Goines, 59, also faces felony charges of engaging in organized criminal activity, tampering with government records and theft by a public servant.
According to the lawsuit, Goines filed a police report stating that Ybarra had a small amount of marijuana and two ecstasy tablets -- a false accusation that ultimately led to Ybarra's drug charge.
