Phantom LIBOR Terms and the Heter Iska

The phase-out of the London Interbank Offered Rate ("LIBOR") has troubling implications for ongoing private agreements that incorporate LIBOR as a floating contract term. Legislatures in the United States, the United Kingdom, and the

I believe Allan Domb will turn out to be the real sleeper surprise of the Philly Mayoral race, not only because of his clear self-funding advantage, but also because he will likely pull together enough of the moderate pro-business constituency to beat out all the progressive candidates splitting their constituency.

That said, Gym has to be the favorite as of now. She's consolidating all the grassroots activist groups and earned more votes than anyone in the 2019 citywide council at-large race.

Phantom LIBOR Terms and the Heter Iska--Part I

Sorry it's in law review language and uses my *other* name, but apparently I'm publishing this as a class action lawyer with experience in LIBOR manipulation cases rather than as the yeshiva guy with thoughts on ha'aramot.

Also, trueheads will know that footnote 19 is the best part. I think this may be the Rebbe Maharash's first appearance in a law review article! I'm working and teaching some more on the "theology of the heter iska" question and hope to have more to say about it soon.

This project was in the works for a long time. Although the specific question I address is breathtakingly niche, I think a lot of you may find this interesting! At the very least, I tried to give a useful introduction to the heter iska that both gets into the weeds of the financial transaction and tees up some questions about the Jewish ethics of lending.
Excited to share my new article on the heter iska and LIBOR in the Banking Law Journal. Part I--providing a background on the history, nature, and function of the heter iska--is out now, and Parts II and III will arrive in the coming months.
Sometimes you read a Sefas Emes and it feels like Tanya.
I'm teaching a series of chaburot on the nature, purpose, and *theological* dimensions of the heter iska. It's a shul event and not open to the general public, but let me know if you'd like recordings and/or sourcesheets.

Miketz thought @mazeldon :

I’ve always thought of Yosef’s actions in Egypt as a traumatized person taking revenge, but I just noticed this pasuk again. It’s conveying pretty clearly that Yosef’s decision to torment his family was driven by his sense of his destiny.
