🚨 New paper! Thanks to the Yale Journal on Regulation Bulletin
for publishing my essay, "Interpreting the Ambiguities of Section 230," in which I argue that refocusing on Section 230 as a standard statutory interpretation problem rather than a policy debate over liability is the best path forward for courts. https://papers.ssrn.com/sol3/papers.cfm?abstract_id=4800612
Correcting Presidential Immunity's Original Sin

In both civil and criminal cases, presidents should generally receive qualified, not absolute, immunity for official acts.

I have a new piece up on @lawfare arguing that the First Amendment does not generally protect the distribution of machine-learning model weights. This is an important legal issue as the government considers AI export controls. https://www.lawfaremedia.org/article/there-is-no-general-first-amendment-right-to-distribute-machine-learning-model-weights
There Is No General First Amendment Right to Distribute Machine-Learning Model Weights

Unlike source code, which humans use to express ideas to each other, model weights function primarily as machine-readable instructions.

A very important point from @[email protected] on how the problem of police violence needs to be framed, given that only a broad multiracial coalition will be able to successfully reform policing.

Not gonna lie, I love this. When I was a policy lawyer at DOJ and had to convince the interagency to come around to DOJ's position on something, I'd bring Milano cookies to meetings. Worked. Every. Time.

Here's the reporting. What's most interesting is the potential for Trump-specific restrictions. https://www.nytimes.com/2023/01/25/technology/trump-facebook-instagram-accounts-meta.html
Meta to Reinstate Trump’s Facebook and Instagram Accounts

Meta said the suspensions of Donald Trump’s accounts would be lifted “in the coming weeks,” with measures in place to discourage repeat offenses. Twitter reinstated Mr. Trump last year.

Good for the faculty at Hamline. Given this overwhelming vote, I can't see how Miller (or any of the administrators involved) can stay on. But this part of the faculty statement is unfortunate. 1/ https://www.startribune.com/hamline-faculty-call-on-university-president-to-resign-amid-dispute-over-art-academic-freedom/600246188/
Hamline faculty call on university president to resign amid dispute over art, academic freedom

President Fayneese Miller has led the St. Paul college since 2015.

Looking forward to tomorrow's Law & Tech. Workshop (4PM ET), in which we'll be discussing @[email protected]'s (@[email protected]) "The Managerialization of Search Law and Procedure For Internet Evidence," with @[email protected] (@[email protected]) as discussant.

Unbelievable. At this point I can't see how she can do anything but resign as president---either on her own initiative or in response to a request from Hamline's board---if Hamline wants to continue to be taken seriously as an institution of higher education.

The president of Hamline University is not backing down at all. She argues it’s not an academic freedom issue, she didn’t fire the professor either.
