MARITAL RAPE
What the Justice considered is just as important as what he did not consider in making his opinion.
The first and perhaps the most important point to evaluate is this: Whether the marriage within the Indian legal system considered - a contract.
If not, there you have a much bigger problem than rape.
The legal scholars need to revisit the idea of "contract" vis-à-vis marriage.

Please allow me to poke holes in Justice Hari Shankar's arguments.
I do not know the current legal system in India. In a cursory reading it appears to me that the Justice has merely offered an opinion ("view) as in, " sex
sex with her without her consent would, in my view, be completely antithetical to the very institution of marriage : J Hari Shankar "
Without doubt the Justice has pondered deeply about the social and legal consequences of his opinion.
It is however not adequate.
