this is insane, CBP can just *say* a permanent resident entering the country has commited a crime, with no burden of proof, and not only forbid them from entering the country but TAKE AWAY THEIR PERMANENT RESIDENT STATUS. what the fuck
the supreme court as an institution is completely corrupt, has been for a long time, and should be dismantled in the long term, at least disabled in the short term, and all of its members should be [non-actionable threat]
@wxcafe It's stuff like this that makes me just sad every time I see the "Let's celebrate 250 years of the U.S.A" because it hasn't really been heading in a positive direction for a good portion of it. Lot's of rich people doing what they want for money that just gets worse over time.
@wxcafe how far-fetched would it be that this is the next step in the legal framework to strip away citizenship from any "enemies of the state"?
@chgowiz i try not to project too far in these regards bc a) i can't do anything about it and b) it's so hard to predict what might happen
@wxcafe Rule of law? What's that? Do you eat it?
@wxcafe did they just literally rule against the rule of law as a concept? ๐Ÿค” This goes beyond authoritarian and into a leather fetish gone wrong
@wronglang well, only for permanent residents who are entering the country, not for citizens or anything like that. but then again the border has been a "special" zone when it comes to the rule of law for a while
@wxcafe that's the thing with the rule of law, there's only one and if it's broken it's broken for everybody. Otherwise they could just codify that permanent residence can be taken away arbitrarily, but they didn't, they said they don't need to follow existing rules and procedures.

@wxcafe

Green card holders should also be careful crossing state lines, because CBP has (previously) declared that is their jurisdiction too.

@wxcafe for those Holmes fans among us, https://en.wikipedia.org/wiki/Oliver_Wendell_Holmes_Jr. , watching America turn into a banana republic has been painful.

@wxcafe Probably those who get kicked out at the border will prove to have been the lucky ones in the next few years of this.
@wxcafe My attorney has always advised me that there is no guarantee that I would be let back in if I left the country. This is certainly an escalation, but deeply unsurprising and not really a game changer for green card holders.
@wxcafe @nileane I have been living for almost 20 years in Japan, now as a permanent resident, and that's my understanding of the residency status here too - any decision about residency is up to the executive, with very little judicial recourse. That was very obvious during covid with many residents kept out of the country or unable to reunite with their family for a long time. (Citizens had no such restrictions.) Often on my mind and a big reason for considering becoming a citizen here.
