So does old mopeds, no one ever called them bicycles coz they had pedals. The EAPC regs are pretty clear what an ebike is compared to electric motorcycles & pedals is not it, just if it's pedal assist or not, whether it's powered by motor over 15mph, uses throttles & motor over 250W. Often it's so easy to work out what they are when they shoot past at speed & not pedaling.
