Manannán mac Lir 🇺🇦 🇵🇸A rare instance of sanity prevailing at the Supreme Court of Canada. I just hope no one's lives have been financially ruined by the horrible Cowichan decision before today's ruling.
The judge in the New Brunswick case said it best: "In the New Brunswick decision, an Appeal Court judge said in December that a declaration of Aboriginal title over privately owned lands “would sound the death knell of reconciliation with the interests of non-Aboriginal Canadians.”"
And they were right.
Now, aboriginals who say they don't want title over private property but have done nothing legally binding to renounce it can no longer weaponize that threat to livelihoods.
Thank you, Supreme Court!
