The Megan Gale case arrives before the Advertising Jury: Iliad “innocent,” no violation of the Code of Self-Regulation.

The Advertising Standards Authority sided with Iliad in the dispute over the operator’s new promotional campaign featuring Megan Gale. The decision closes, at least for now, a dispute that had fueled confrontation in the telecommunications sector and also attracted attention outside the strictly advertising sphere.

At the center of the controversy was Iliad’s choice to use Megan Gale, an iconic face of Omnitel and Vodafone campaigns between the late 1990s and 2008. This decision prompted Fastweb, after acquiring Vodafone Italia, to contest the use of the image of the former spokesperson, arguing that it could create an inappropriate link with the fame built over the years by the historical brand.

According to the competitor’s position, the campaign could have constituted a violation of the rules on commercial communication and the provisions of the civil code, due to the recall of the collective memory of previous advertising linked to Vodafone-Omnitel.

IAP closes the case

The matter was brought before the Jury of the Institute for Public Advertising Self-Regulation (IAP), which examined the documentation and heard the parties involved. In its decision, the body ruled that the communications in question were not in conflict with the Code of Self-Regulation.

In effect, the verdict confirms the legitimacy of Iliad’s campaign and its use of Megan Gale as a spokesperson, closing the case on the grounds of advertising self-regulation.
