Brussels argued it does not have the legal authority to ban the practices and feared encroaching on the prerogatives of member states. It will therefore leave it up to them to take action.

We considered several options, and, although a Recommendation is a non-binding legal act, it is the best and most effective instrument to achieve the objective of the ECI. That’s because banning conversion practices by means of criminal law is a competence of EU countries. Some countries have already done so. @EUCommission the article I quoted pinpoints the major issue with this stance: some union countries are currently enforcing laws against lesbian, gay, bi and transgender people. You missed the opportunity to actually enforce progressive laws union-wise to prevent the worse, but chose not to. To some, you say it’s « the best option », and to some others, you say it’s « the only option, we don’t have that kind of power » (basically what’s been reported by Le Monde), and this misinformation is truly embarrassing at your level o responsibility.

I also take issue with your online presence and nature of your posts: either you claim to protect LGBTQI+ folks in the EU and act accordingly; or you let every country decide for themselves, but in this case accept that the Union isn’t safe for LGBTQI+ people. You cannot just opt for the second option and then post memes about how ✨ MARVELOUS ✨ your policies are.

Tl;dr: you’re right to feel uncomfortable about all of this, and frankly your (lack of) policies show cowardice on your end.
