There is a word, single word, that describes sexual acts with a person when they have not consented (due to incapacity, age or under influence of substances that may cause impairment, among other things). Same for when such consent is withdrawn at any point. If the allegations have merits, the alleged perpetrator needs to be arrested and charged and face a trial.
