Elon Musk’s long‑running clash with OpenAI chief Sam Altman has intensified, with the SpaceX founder now suing to have Altman removed from his leadership roles. In a fresh set of court filings submitted on April 7, Musk’s attorneys argue that Altman and OpenAI president Greg Brockman should be stripped of their positions after a judge and jury find the company defrauded Musk by promising to remain a nonprofit while soliciting his $38 million donation.
The complaint seeks an order that ousts Altman as a director of the OpenAI nonprofit board and removes both Altman and Brockman as officers of the for‑profit arm. Musk, who helped launch OpenAI nearly a decade ago, claims the restructuring completed last October left him with only a 26 % stake in the for‑profit entity that now runs ChatGPT. He is also asking the court to revert OpenAI to nonprofit status, citing the removal of charity officers as a standard remedy when they fail to uphold the organization’s public mission.
Jury selection is slated to begin on April 27 in a federal court in Oakland, California. OpenAI responded on X (formerly Twitter), characterising the lawsuit as a “harassment campaign” driven by Musk’s desire for greater power and profit, and accusing him of “pretending to change his tune” about the nonprofit foundation. The company contended that the case is less about legal grievance and more about Musk trying to slow down a competitor.
