“La verità è molto più complessa di un fermo immagine”. Lo ripete con amarezza l’ex cassiera di un supermercato modenese di Coop Alleanza 3.0, licenziata nel 2024 per non aver battuto due prodotti – uno scolapasta e una pentola wok – dal valore complessivo di poco più di 30 euro. Intervistata dall’edizione bolognese del Corriere della Sera la donna ha fornito la sua versione dei fatti. La vicenda, ripresa dalle telecamere del negozio, è finita davanti al Tribunale del lavoro di Modena, che ha rigettato il ricorso della donna, condannandola anche al pagamento di 1.500 euro di spese legali.
Dopo trent’anni di servizio, la cassiera denuncia di essere stata ingiustamente descritta come complice di un presunto raggiro. “Leggo ricostruzioni che dipingono una realtà parziale, quasi fossi un’abile complice – sottolinea – ma nessuno ha evidenziato che le due clienti coinvolte erano note per precedenti tentativi di raggiro e vivevano in roulotte vicino all’Ipercoop”. Secondo la lavoratrice, i due prodotti non registrati erano gli unici della spesa manomessi con codici a barre alterati. “La manomissione era tale che nemmeno il lettore ottico riusciva a leggere i codici”, spiega. “Se avessi scansionato le etichette, avrei consentito la truffa; non passarle affatto mi ha solo esposto al controllo del vigilante”. Questa la sua spiegazione a fronte della motivazione redatta dal Tribunale del lavoro che citava proprio le immagini delle telecamere per sostenere la malafede della lavoratrice.
La cassiera esprime inoltre amarezza per la reazione dell’azienda: “È paradossale: la Coop ha scelto di colpire me, una dipendente con vent’anni di servizio, basandosi su una presunta volontà dolosa, proteggendo di fatto le due presunte truffatrici”. Al suo fianco l’avvocato Gabriella Cassibba chiarisce che “la vicenda merita un ulteriore e più approfondito vaglio giudiziale, perché la linea tra errore esecutivo e dolo va valutata nel contesto concitato in cui la lavoratrice operava”. Il verdetto del giudice è impugnabile e quindi ci sarà un appello per discutere di nuovo il caso.

Interviewed by the Bologna edition of Corriere della Sera, the woman provided her version of events. The case, captured on the store’s cameras, ended up before the Modena Labour Court, which rejected her appeal and ordered her to pay 1,500 euros in legal fees.

After thirty years of service, the cashier claims she was unfairly portrayed as an accomplice in an alleged fraud. “I read reconstructions that paint a partial reality, as if I were a skillful accomplice – she emphasizes – but no one has highlighted that the two involved customers were known for previous attempts at fraud and lived in RVs near the Ipercoop.” According to the employee, the two unregistered products were the only items in the shopping cart altered with altered barcodes. “The alteration was so significant that not even the optical scanner could read the codes,” she explains. “If I had scanned the labels, I would have allowed the fraud to occur; not passing them off at all only exposed me to the security guard’s check.” This was her explanation in the face of the motivation drafted by the Labour Court, which cited the images from the cameras to support the employee’s bad faith.

The cashier also expresses bitterness at the company’s reaction: “It’s paradoxical: Coop chose to target me, a twenty-year employee, based on a supposed willful intent, effectively protecting the two alleged fraudsters.” Her lawyer, Gabriella Cassibba, clarifies that “the case deserves a further and more in-depth judicial examination, because the line between executive error and intent must be evaluated in the hectic context in which the employee operated.” The judge’s verdict is appealable, and therefore there will be an appeal to discuss the case again.
