The United States has signed and ratified the 1948 Convention on the Prevention and Punishment of the Crime of Genocide.

Articles II and III define punishable acts, including "conspiracy to commit genocide" and "direct and public incitement to commit genocide".

Trump has done both.

Also Article 2 states, "acts committed with intent..."
Its genocide if there was intent in the actions. It says nothing about how successful those actions have to be.
