Originalism is a viral fever which, like any fever, will eventually either burn itself out or kill its host. But the Bruen line of cases is a whole order worse, that wild psychotic fever-nightmare that may cause lasting damage to your sanity. It’s lunacy. What are we doing?!

Future legal historians are going to refuse to believe their eyes. Like, wasn’t there a whole revolution thing? How did one crank justice—who is a mediocre jurist and a tenth-rate historian—force judges to cite laws from 4 centuries BEFORE THAT REVOLUTION?
And why hasn’t the entire legal response been “what in the absolute F*** is going on here?!” I’m not criticizing the historians who are seriously pointing out the flaws in the conservative Originalist arguments—that’s a necessary form of chemo. But our overall rxn is not outraged enough.
