Emulation has never been considered a crime, it is a practice totally legal.

What is illegal is running licensed software, or promoting the emulator to run licensed software.

In a recent case of a (perhaps) Switch emulator, Nintendo was "able" to demonstrate that emulator was promoted to run pirate games.

Therefore devs decided to not start a legal challenge against Nintendo.
