Ontario Court Justice Mike Boyce ruled that publishing the video didn’t pose a risk to the fairness of Luloff’s trial because the evidence was already heard and admitted. The trial was also a judge-alone trial, which meant no jurors or witnesses will be influenced by the publication of the evidence.

Boyce also ruled that the administration of justice would be strengthened because the public would be able to see what took place, including the conduct of police. ...

“We don’t have secret trials. We don’t have justice occurring in secret. We’ve decided, as part of our democracy, that the public should be able to see the court system in action in order to provide a level of accountability, in order to have confidence that the court system is working in a fair and equitable way,” [U of Ottawa law prof Amy Salyzyn] noted.
