Sadly, the HSE website has "COSHH does not cover situations where:
- one employee catches a respiratory infection from another
- a member of the public has infected an employee with coronavirus through general transmission in the
workplace"

Even if that statement from the HSE is eventually held to be wrong as an interpretation of the law, it's probably enough to confer immunity from prosecution on employers under the principle from the John Downey trial.
