Thr problem is that there is supposed to be criminal prosecution for this felony so the courts won’t entertain private lawsuits over it. Meanwhile the responsible authorities aren’t willing to arrest and prosecute.

Interesting premise. If we use rocket launchers full of cash to break Tesla windows, does it then become legal? Musk’s actions in Wisconsin are a strong precedent here.
