An open letter to His Excellency Alexandre de Moraes

#Elon rises again as the champion of the people. This didn't end well for the United States during the #Clinton administration; it didn't end well for the Australian government's legislation after that; it most certainly failed gloriously when Hosni Mubarak believed he had 'turned off' the Internet in #Egypt; and it isn't going to end well this time around for the doodoohead judiciary of #Brazil either!

As many of you are used to hearing me say, "Stupid goes all the way to the bone". Yeah, I gots lotsa 'isms 🀘😜🀘

On that note, today's #bonehead award goes to judge #Alexandre_de_Moraes, who remarkably, has just proven that it is indeed possible to fuck yourself in your mouth. Most of us didn't even realize the abyssal depths of such stupidity he just achieved actually existed.

Yo! Moraes! You're no #Captain_Picard; you can't just say "Make it so" and have that be the case.... You're a first class moron, and what did you really expect after threatening that attorney's life? Did you really expect Elon to name someone in her stead for you to disappear?

#X is now closed in your country. Elon announced that about a week ago now, so the company isn't actually extant within the confines of your #Banana_Republic jurisdiction.

Here's what you can do now. You can decide what Internet traffic may and may not be allowed to traverse your data centers (good luck with that too), and see what the citizens of your nation have to say about it. Already, many of us are waiting and ready to provide Wireguard services that will instantly emasculate you - such is your prerogative, to enact a #Great_Firewall_of_Brazil - just like they have in Merry Olde England. Don't you just love dystopian constructs like #Ofcom?

You might wish to hold a straw poll of the citizens of your nation, or experience the flavor of your own ejaculate. How dare you tell the good folks of your nation what they are and are not permitted to see under penalty of imprisonment!

You're now venturing into territory where the much mightier have already fallen. I'd tell you to stay in your lane, but I think I'm much more interested in selling a lot of popcorn 🍿 to this little career ending shit show.

We've had the #Clipper_Chip, the #V_Chip, and other sorts of choke chips and there's not a single solitary systems engineer worth their salt who wasn't an unindicted, bonafide felon in the United States prior to the Ninth Circuit Court of Appeals in ruling U.S. v. Bernstein as unconstitutional for infringing the First Amendment.

The legal rep they had (and office which is now closed) was directly threatened by the judge and if I'm not mistaken, has herself left her own country for her personal safety.

So yes indeed, "X" has left the country - literally packed up and left, bye bye. But here's where the show begins to get really entertaining...

#Moraes has himself just crossed the line of what is a completely foreign concept to Americans, as only the legislature is empowered with creating law under our constitution. The courts, interpret law. Sure, there's executive orders but those are NOT laws, not are they ratified treaties. That is the domain of Congress and not the president. And with respect to our judiciary, legislating from the bench is strictly taboo.

Not so in #Brazil, apparently, where this corrupt (Supreme Court) judge has effectively usurped their own lawmaking bodies and is creating law.

@tallship This is just Musk's narrative. I agree that the fine is going too far, as it affects people that are not involved in the problem. But you have to understand that this is Brazil. The American Constitution doesn't matter to us. We have different laws. It is illegal to be a Nazi here. A lot of stuff that Musk said was freedom of expression would only apply on the U.S. This is a different country. That is why they need a legal representative here.

Yes I agree that conflating Starlink with X was bad optics, probably outright wrong as a legal decision (I can't be sure whether there is a relationship between the two companies not disclosed or that we're aware of).

But the point I think we've already both identified is that X already GTFO'd, so it's no longer anything to do with Brazilian law or moreover, the Nazi judge's decrees, from the perspective of a foreign corporation not doing business there. IANAL (I am not a lawyer), but I believe the crux of the matter is that it's a U.S. company that has done nothing wrong under U.S law so the Brazilian government has basically just the choice between blocking the traffic and not blocking the traffic within the boundaries of their jurisdiction - the choice, is apparently the former, which is totally kewl and well within their authority to do so.

As far as my pondering whether the judge is empowered to actually legislate from the bench under your laws... I really do not know the answer to that, I merely contrasted the action with how it is here with such things between the legislature and the judiciary.

I should probably offer an apology, which I do, for lampooning what I posited as the foolish direction I predicted Moraes would take (like I said in my first post, the powers that be tried that shit here and in Australia and Egypt amongst other places and it didn't end well for them), but the man went and proved himself a fool and now he's threatening your own countrymen...

This is what is called an exercise in futility.

It should also be pointed out that likewise, it is really only a pyrrhic victory for Elon, but hey, he's got plenty of money to burn.

With respect to the freedoms and lack thereof that are enjoyed by people on the Internet, this already is a huge win for humankind, in the face of tyranny.

There is one more, existential point that I simply must clarify here. The Bill of Rights are NOT* rights granted to the American people by the U.S. Government. Those rights are bestowed upon all of mankind by The Creator; and as such it is merely a guarantee, in the form of a social contract. To wit: a solemn promise that our government will respect and not infringe upon those God given rights.

Most other governments seem to think they have the authority to grant those rights - They Do NOT.

The governments of Merry Olde England and Brazil would be wise to remember that, and stay in their own lane.

@tallship This is your personal religious opinion. Most would argue it is not an individual's right to own nukes, so it is already understood that some weapons are to be regulated. Therefore, it is ridiculous to think humans have "God given rights" to own guns, for example. It is just different laws in different countries. Implying that your constitution is some god given piece of paper that should be imposed into every country is the biggest piece of American entitlement I've seen in a while.
