Everything was locked in then. Nothing in the following 8 years could change what was going to happen.

The crenellated nature of the common law system coupled with a ultra politicized nomination and confirmation process is a recipe for disaster. How do you see a court creating critical law for ages and not fix it? A court is supposed to apply and interpret, not create.
