2/ Judge says he's been under the weather.

Says neither Wade nor Bradley established that atty/client privilege applied.

Judge McAfee kicks off w/ a summary of why we're here:

After meeting w/ Bradley in private, I found that neither Wade nor Bradley carried their burden of establishing that attorney-client privilege applied wrt whether there was a relationship btween Willis and Wade.

Bower:

Merchant, for Mike Roman, starts us off, asking Bradley about the timing of the relationship between Willis and Wade.

He says he has no knowledge of when the relationship began.

6/ Bower:

Merchant: Do you think the relationship between Willis and Wade started before she hired him?

Abbate objects; overruled. Merchant shows the state an exhibit of text messages that she intends to show Bradley.

7/ Bower:

(If you recall, Merchant is the squeaky-voiced blonde Trumpy who is beyond annoying)

Merchant: Do you remember telling me via text that you told me the relationship started when Willis was a judge in South Fulton?

Bradley: I see the text but don't recall sending the message.

Merchant: Do you remember telling me "absolutely" when I asked if the relationship began before Willis hired Wade?

Abbate, for the state, objects, arguing that Merchant hasn't established how Bradley might know about the timing of the relationship.

9/ McAfee says that Merchant needs to establish foundation for the source of Bradley's knowledge.

Merchant: When did the relationship start?

Bradley: I can't answer that.

10/ Merchant: When did you first have knowledge of their relationship?

Bradley: I've said time and time again that I don't have knowledge of when the relationship began. So I can't answer that.

11/ Merchant: When did you first know about the relationship?

Bradley: I don't know how to answer that...I can't give you a date. If you're asking how I got the knowledge, it came directly from a client.

Merchant: So you don't know a specific date?

Bradley: No.

12/ Merchant: Did you know in 2019?

Bradley: '19, I would probably say no....At this time, I'm telling you that I do not have the date.

Merchant: You received contract from Willis in Jan. 2021. Using that date, had they begun a relationship?

Bradley: I don't recall.

13/ Merchant: Do you remember knowing Willis prior to her taking office?

Bradley: I knew her very little before she was DA.

14/ I'm watching, and Squeaky is struggling, judge has to keep coaching her. Judge is losing patience.

15/ Merchant: Do you remember telling me that not many people knew where they met?

Abbate: Objection, lack of foundation.

Merchant: Where did you gain knowledge of your statement that Willis and Wade started when she was judge in South Fulton?

Bradley: I was speculating

16/ Bradley: I was speculating...no one told me that. I never witnessed anything...it was speculation. I can't tell you anything specific as to why I speculated about that. It was many years ago.

Merchant: Did you have reason to lie to me?

Bradley: Idk if speculation is lying

Wade's former partner, Terrence Bradley, says he can't recall if Wade and Willis were in a relationship at the time they hired him at the DA's office in 2021. He says he can't recall.

The lawyer for Mike Roman, Ashleigh Merchant, is struggling to establish much of anything.

18/ Bower:

Merchant: What did Nathan Wade tell you about the relationship?

Bradley: I recall him stating that at some point they were dating. I can't tell you what date that was. We were in our offices. There was no one else present. That's all I can tell you at this time.

19/ Merchant: You had one conversation with him about Willis?

Bradley: One time. I only recall one time.

Merchant: Was it before you got the 2021 contract w/ Fulton County?

Bradley: I do not recall.

20/ Merchant: You received an email from me on Jan. 6 w/ my motion to disqualify attached. And you I spoke about it. Do you recall?

Bradley: I can't recall if it was text/phone...we discussed the accuracy of how much money my office received & if that would go in the motion

21/ Bradley: I didn't reach out to you and say send me a copy of your motion. But I looked at it and I noticed that you had left out my part of the money the partnership received through my part of the firm. So I said that should be put back in for accuracy.

22/ Merchant: And then I asked you if the motion to disqualify was accurate and you said "looks good"?

Bradley: Yes, but "looks good" was applying to the accuracy of how much money my firm made through its contract w/ DA's office...not motion as whole

23/ Merchant: But I asked you in my email "Anything else that looks inaccurate?" And you responded "looks good." Isn't that right?

Bradley: Again, I was responding to the amount that my firm made from the contract w/ the DA's office, not anything else.

24/ Judge has to keep telling Merchant how to do her job.

This is going nowhere. At least not yet. And it's really frustrating to watch her badger him.

25/ Merchant: What did Wade tell you about he and Willis meeting at her office in Evans?

Bradley: I can't recall what the conversation was...I do recall knowing that he would go down to the office but can't tell you when or what happened there.

26/ 🤦🏻‍♀️ Merchant: Wade told you they had sex at that office?

Bradley: I don't recall.

Merchant: Do you recall Wade telling you that he had a garage door opener to access one of Ms. Willis's residences?

Bradley: No, I don't have any knowledge

27/ Merchant: So when you told me that he had a garage door opener for Willis's residence, you were lying?

Bradley: I don't recall telling you that....

28/ Merchant: Do you remember telling me that it didn't surprise you that Willis and Wade took many trips together because they also took trips together to Florida, Texas, etc.?

Bradley: I don't recall that.

29/ Merchant proffers exhibits showing some of her texts with Bradley in which he made comments about Willis and Wade taking trips together.

McAfee is getting impatient with Merchant's line of questioning...he says she needs to move on soon.

30/ Merchant: Wade didn't tell you about his visits to Ms. Willis's home in Hapeville?

Bradley: He did not give me details...At this time, I don't recall, no.

Merchant: Where did you get that information?

Bradley: I don't recall where I got that info.

31/ Merchant: You definitely did not want to be a witness in this case?

Bradley: Correct.

Merchant: After Gabe Banks (an attorney/friend of Bradley & Willis) called you, it was after that that you hired your attorney, BC Chopra?

Bradley thinks it was before but not sure.

32/ Merchant: You called and texted me after Gabe Banks called you?

Bradley: yes

Merchant: And at that time you didn't say anything to me about being represented by Chopra?

Bradley: yes

Judge just told Squeaky he'd cut her off after 5 more minutes. He's had it.

33/ Merchant: Do you recall me asking you if the relationship started before she hired him and you replied "absolutely"?

Bradley: Yes

Merchant: And I asked you how they would react, and you said they would deny it?

Bradley: I see that's what the message says

I don't understand what's happening here. Squeaky is making a lot of assumptions it seems, as Bradley continues to disavow knowledge of such things. Shouldn't Squeaky have evidence?

@tdwllms1 @GottaLaff I have felt all along the the co-conspirators will throw every piece of garbage, etc, at Willis/Wade, in hopes of some of it sticking. Desperate they are.
@GottaLaff it seems like a hail mary and the judge is giving her all KINDS of leeway. It's easy to see how both Wade and Willis lost their patience with her. i just don't get how this is allowed to go on, but as Teri Kanefield often advises - it's all part of the game.

1. Judge is giving lots of leeway to give the defense team as much opportunity as possible to come up with a valid argument for disqualification
2. Judge is giving lots of leeway so that when he tells them "Frankly, you have nothing here," they have no
possible grounds to protest "But you didn't give us the opportunity to make our case!"

@GottaLaff at what point does the judge call out this badgering? i mean - he has answered this question four or five times now. This is not the witness Merchant thought he was and the whole issue of a foundation ... for credibility ... is completely missing, and she can't get him to create one for her.
