BREAKING: Musk's SpaceX and his anti-labor lawyers at Morgan Lewis filed their motion for a preliminary injunction tonight in their case aimed at getting the National Labor Relations Board declared unconstitutional: https://storage.courtlistener.com/recap/gov.uscourts.txsd.1946370/gov.uscourts.txsd.1946370.37.0.pdf
This has a bit of a slow fuse right now, because it's not happening yet and because there's so much else going on, but this is a very important case to watch.

And, yes, as I discussed when this case against the NLRB was filed, it follows on some issues in the SEC case pending at SCOTUS this term. However, those arguments didn’t go as well as Jarkesy’s lawyer (and the 5th Circuit) would have liked, so it’s not clear right now how it falls out. My coverage of that: https://www.lawdork.com/p/the-sec-case-is-really-about-congresss
The SEC case is really about Congress's power to let agencies address today's problems

If they succeed in getting the Taft-Hartley Act thrown out, does that bring the Wagner Act back into force?

@chrisgeidner How likely is Musk to win? This seems like a long shot.
@chrisgeidner
Just like a week ago, the pres. of the UAW said that a general strike could be declared by 2028. Sounds wild, but if a GOP stacked Supreme Court agrees with a billionaire that the NLRB should be gutted... well, that might be the thing that throws us over that edge.

@chrisgeidner
They take away those near century old soc-dem FDR era protections and watch how fast this country shuts down. So, go ahead, do it. Destroy the last vestiges of the post war compromise. I dare you Elon. I dare the GOP. I dare this Supreme Court and their billionaire chums.

See how fast we get a general strike. No protections, no work. Simply as that. The wealthiest empire the world has ever known will be ground to a halt in a matter of hours.

@CaptBobbers @chrisgeidner I imagine a Republican president (and the odds are good that we'll have a Republican president in 2028) would call out the Army. Strikers would be shot. That's what happened in Britain in 1926; that's what happened the last time there was serious labor unrest in the United States (also in the 1920s).
Personally, I think we should defund every one of Musk's businesses. Why should our tax dollars support this bullshit?

@LPerry2 @chrisgeidner
Oh, I'm not saying it'd be a good time. Quite the contrary. In some regions, it would resemble a civil war.

No one should be burdened with the misconception that mass labor action against the billionaire class will be easy or that people won't get hurt; that the government will be the ones doing the hurting. Everyone should remember... folks were murdered to get us the protections we have today. We're barreling towards a "second awakening" of the working class.

@chrisgeidner Meanwhile in Europe Musk is getting a spanking because Europe has stronger labour laws that are, for example, causing problems for Tesla.
@chrisgeidner No words except OMG. Bookmarking to read more about later.
@chrisgeidner I really wish that NLRB could respond by filing a counterclaim for declaring zillionaires unconstitutional, together with a motion for a preliminary injunction.
