Trump enters the courtroom for Day Two of his civil fraud trial.

Big:

Justice Engoron clears up how proceedings ended yesterday on the statute of limitations, based on his colloquy with Trump's attorneys.

Engoron:

"Every use" of a false statements of financial condition "in business starts the statute of limitations running again."

He understands that the defense "strongly" disagrees with this โ€” and will appeal.

3/ Toward the end of the day yesterday, Engoron urged the NYAG to connect the witnesses testimony about 2011 to events from within the statute of limitations.

The state "promised me to connect the dots," he noted.

Engoron indicated that didn't affect his ruling.

4/ Adam Klasfeld:

Throughout ongoing testimony by Trump's ex-accountant Donald Bender at Mazars, Trump's attorneys keep lodging statute of limitations objections to certain testimony.

Justice Engoron keeps overruling them.

5/ After recess, Engoron appears impatient abt Team Trump's repeated, habitual & constantly overruled objections on stat of limitations.

Engoron notes, under NY Court of Appeals precedent, they don't have to keep doing that to create their record.

Continuing objection is enough, they don't even need to lodge a continuing objection: Engoron

Trump lawyers say they're concerned about an exception.

Engoron: "I'll let you do what you feel you need to do," i.e. to preserve record for appeal.

6/ Via Kyle Griffin:

Ex-Trump accountant Donald Bender has testified that the information he used to compile Trump's financial statements came from the Trump Organization โ€” not him.

Judge Engoron has already found the financial statements were grossly inflated and fraudulent.

7/ Adam Klasfeld:

Trump's ex-accountant Donald Bender is now inspecting a statement of financial condition from June 30, 2017.

Bender is shown an engagement letter signed by Donald J. Trump and Allen Weisselberg.

Asked if Mazars would have signed the letter if they learned that its representations weren't true, Bender responds: "No, we would not have."

MEANWHILE, via Kyle Cheney:

Trump, on Truth Social, is attacking Judge Engoron's *clerk," โ€” who is literally in the courtroom with him โ€” while calling her "Chuck Schumer's girlfriend" and posting a link to her Instagram account.

I suspect this will be an exhibit in some gag order arguments.

Ex-Trump accountant Donald Bender testified that at one point he discovered Trump and the Trump Org. were withholding docs that he should have had as he compiled Trump's financial statements, saying they'd failed to turn over "paper documents over a number of years."

10/ Day Two of trial ends with the same witness.

Bender's cross-ex resumes tomorrow, followed by Camron Harris of Whitley Penn.

I never understood this. Since when did presidential candidates receive more rights than ordinary citizens. I understand that itโ€™s best to ratchet up punishments up until jail, but I donโ€™t see how running for president from a jail cell is an infringement on 1A rights. @GottaLaff @jsj

I'm trying to work out how he can be on TS attacking the clerk if he's in the courtroom? Sorry if it's a rubbish question, I have no knowledge of courtroom etiquette in any country,

@GottaLaff Besides putting yet another public servant in the crosshairs, it also begs the question: Who is posting on Trump's budget Twitter on his behalf? Dan Scavino? Liz Harrington?

@GottaLaff I, also, feel badly for the Alison Greenfield in Kansas who, Iโ€™m sure will receive her share of hate mail because she has the same name. I realize no judge wants to test what will happen if they have to revoke his bail, but violence could happen in both circumstances. Better to follow the law.
