Overt Acts and Predicate Acts, Explained

No, Fani Willis Is Not Making Tweets Or Phone Calls Into Crimes. But Maybe Her Indictment Is A Bit Indulgent And Gratuitous.

The Popehat Report

@Popehat "Why Fani Willis Isn't Trying To Criminalize Phone Calls or Tweets..."

This is like if the NRA tried to argue "armed robbery" was trying to criminalize using guns.

... Now that I say that, that's probably something they would do.

@Popehat it can be gratuitous and not be a problem.
@Popehat good read. Appreciate the source links. It will be interesting to watch the defendants in federal offices pulling the rip cord and floating off to a federal court that has a more critical eye toward the arguments Willis is making.
@Popehat Riddle me this: Let's say the unlikely occurs and Fani Willis is impeached at any time before the trial's conclusion. What happens then?
@jpwkeeper
OJ Simpson becomes the judge.
@jpwkeeper @Popehat Simple: her replacement takes over the case. Indictments are done by grand juries, not prosecutors, and the case is between the defendants and The People, not just whoever happens to have the D.A. job at the moment.
@grumpybozo @Popehat Who decides to her replacement is in Georgia? And if that replacement is a loyalist, could they not just drop all charges?
@Popehat It's sloppy. Which in a historic case is probably going to hobble it. Feels very "OJ" to me.

@Popehat to presume trumpers and anti-anti-trumpers even regard rule of law is a sight naive, tbf.

They're not operating by same rules. Hell, the only rule they follow is "we get our way".

So... eh.

@Popehat
Poor Belgians, if being invaded in two world wars wasn’t enough, they’re now on Ken’s shitlist.
Where you spurned by a foreign exchange Belgian student at college? Did she lure you in with talk of quality beer and chocolates?
I think the people should be told.
@Jodami @Popehat He must of gotten some bad endive.
@Popehat I get your point but you make it sound as if trumpers care at all what is actually in the indictment.

@Popehat I always have to be on the lookout for my desire for vengeance on these trumpist gop hacks and their paid goons. Vengeance is how the fascists and authoritarians pull folks into their orbits, every time.

Even knowing that, I have to admit I am having a hard time controlling my anger, having seen the video just this morning of Trump's goon Trevian Kutti attempting to put the screws to Ruby Freeman.

I do not give a f who Trevian Kutti is, or how Trump trawled her out of the R Kelly cesspool to come and do similar dirty work for him. But the fact that Trump has likely spent a lifetime employing people and tactics like this, against real human beings, is making me stupid-angry and thirsty for vengeful justice on the man.

Your articles remind me that prosecutors are often not much better, and that helps; but jfc, I sincerely need to step away from the news rn.

@Popehat
Thank you for clarifying the eye-glazing indictment in a way I can comprehend.
@Popehat I continue to appreciate all of the work you put into these things, Ken. Thank you! I feel like, even after you said similar things in the podcast, I understand these things a little better.
@Popehat is that what a bunch of idiots agree to do in their cups, and what they are interested into putting into effect in the morning, are two very different things.
Giggle.
