CCDH did threaten in their letter to Elon's lawyers that if Elon insists on pressing forward and filing a lawsuit, they'd be using their powers of discovery to get all of Twitter's internal information about how they identify and categorize and measure hate speech, their metrics on hate speech; and additionally information about their advertising income (which are all directly relevant to the complaint).
This filing is just performative by Elon, to try to create a chilling effect to discourage anyone else from writing articles that make him sad. As soon as he's being required by discovery to turn over information detailing the fact that Twitter has basically no real measurements of hate speech, and the sad state his advertising revenue is in, he'll drop the suit because he won't want to turn any of that over.
