Even lies are protected speech: New Trump indictment bulldozes the First Amendment

In order to secure convictions for this, Special Counsel Jack Smith would need to bulldoze not just the First Amendment but also existing case law holding that even false statements are protected.

@MarkusDude1000 @Teri_Kanefield that’s a fucking dumb article. The indictment lists what Trump *did* to overthrow the government, not what he said. It’s why incitement isn’t on the indictment. He conspired with others in the false elector scheme. That’s not a free speech issue. This guy is an idiot because the first amendment is not being bulldozed here.
@cadenza That's your take on what he allegedly did; the charge is a loser but it might stick with a D.C. jury and an Obama judge. The true outcome will be seen on appeal. Same as when Smith watched his b.s. Bob McDonnell "win" get overturned by SCOTUS, 9-0.
@MarkusDude1000 There are multiple witnesses, all of them Republican, to the fake elector scheme. The J6 committee did a lot of legwork proving that one, and no doubt Smith was able to corroborate all of it or it would not be in the indictment. He was in the meetings directing how it would play out. The venue has nothing to do with whether he would be convicted. It’s in D.C. because the crime was committed in D.C.
@cadenza That's probably the best Smith has, although I haven't read the indictment nor the applicable statute. As to venue, the actions were everywhere but D.C., although that is, obviously, where the federal government resides. Not challenging venue, just pointing out that it's severely unlikely Trump will have a chance of an unbiased jury. Wonder if the J6 committee destroyed exculpatory evidence related to that charge, too. Since they did inexplicably destroy a lot of the documents & videos.
