Texas judge still fighting to deny wedding ceremonies to gay couples

McLennan County Justice of the Peace Dianne Hensley filed a lawsuit after a state agency warned her about refusing to marry gay couples. She hopes a recent U.S. Supreme Court case about religious freedom helps her cause.

Note that the judge is represented both by First Liberty, which represents the baker in Klein v. Oregon (remanded by the S.Ct. for further consideration in light of 303), and Jonathan Mitchell, who devised SB8.

So unlike the Michigan salon case, where the salon owner was making statements that won't be helpful to its case, players very familiar with S.Ct. litigation are helping push the envelope in the Texas judge's case.

@Dahlialith A judge cannot cite religious objections because he represents the state government and not his own personal religious views...
@toxtethogrady it's not clear to me this particular judge understands much law...
@Dahlialith This was entirely predictable in 2023. It is part of a long-standing push by conservatives to nullify civil rights laws on religious grounds. If this judge wins, why can’t an Odinist county clerk refuse to register Black voters on religious grounds? Why can’t officials refuse to count those votes?
